Welcome to CloudWind Technologies LLP (cloudwind.in). By accessing or using our website, you agree to comply with and be bound by the following Terms & Conditions, along with our Privacy Policy. Please read them carefully before using our services.

CloudWind Technologies LLP reserves the right to update, revise, or modify these Terms & Conditions and Privacy Policy at any time without prior notice. Continued use of our website or services after changes are posted constitutes your acceptance of those updates. If you do not agree, you should discontinue use immediately.

Our services—including products, software, and manpower solutions (collectively referred to as “Services”)—are offered subject to these Terms & Conditions and the Service Level Assurance Agreement (SLA). By subscribing to or engaging with CloudWind Technologies LLP, you acknowledge that you have read, understood, and accepted this Agreement and all related policies.

• Acceptance of a quotation or payment of an invoice confirms agreement to these Terms & Conditions in full.
• Quotations remain valid for 30 days. Services not listed in the quotation are not included in the contract.
• Any additional work requested by the Client will be subject to a separate quotation and may affect project timelines.
• Clients are responsible for providing the required content and information promptly. Delays may result in the project being marked complete, with outstanding fees payable.

Note: Clients are solely responsible for adding content to their websites unless otherwise agreed in writing.

• Ownership of completed designs, source code, and related assets transfers to the Client only after full and final payment.
• Without a written agreement, all rights remain with CloudWind Technologies LLP.
• Clients are granted a non-exclusive license to use the design on one website/domain only. Resale or redistribution is prohibited without prior approval.
• The Client must ensure all content provided is original or properly licensed. CloudWind will not be liable for copyright infringements.
• CloudWind reserves the right to include discreet design credits and portfolio references unless otherwise agreed in writing.

CloudWind will not handle or host:

• Illegal, offensive, or inappropriate content.
• Content containing viruses or malicious code.
• Content promoting harassment, racism, obscenity, violence, or criminal activity.

• CloudWind does not sell domains or hosting. Assistance in purchasing can be provided, but the Client remains responsible for ownership and renewal.

• Designs may differ slightly between design software previews and live web browsers due to rendering differences.
• Alterations must be requested in writing. Additional requests beyond the agreed scope will be separately quoted.
• Optimised pages (SEO meta tags, descriptions, keywords, etc.) are included only if specified in the quotation.
• CloudWind strives to ensure compatibility with standard browsers (latest versions of Chrome, Firefox, Edge, Safari). Functionality across all browsers/OS combinations cannot be guaranteed.
• Clients editing website code themselves (or through third parties) assume full responsibility for resulting issues.

• Websites are tested against WAI Level A accessibility and W3C CSS standards at the time of delivery. Future compliance with updated standards or third-party themes/plugins may incur additional charges.

• Prices are exclusive of GST and may change without notice.
• Payments are staged and must be made in advance of work.
• Invoices must be cleared within 7 days unless otherwise agreed.
• CloudWind strives to ensure compatibility with standard browsers (latest versions of Chrome, Firefox, Edge, Safari). Functionality across all browsers/OS combinations cannot be guaranteed.

• Services are provided “as is” without warranty of uninterrupted or error-free performance.
• CloudWind is not liable for software bugs, hosting failures, third-party issues, or damages caused by external factors.
• Clients are responsible for backing up data and maintaining updates (WordPress, plugins, etc.).
• Free error correction is offered for 3 months post-completion, provided the original hosting environment remains unchanged. Beyond this, corrections will be chargeable.
• CloudWind is not responsible for compliance with laws, taxes, or e-commerce regulations applicable to the Client’s business.

The Client agrees to indemnify and hold CloudWind harmless from any claims, liabilities, or losses (including legal costs) arising from:

• Website content, domain names, or business practices.
• Intellectual property infringement.
• Delivery of defective or misleading products/services by the Client.

Both parties agree not to disclose confidential information without prior written consent, except as required by law.

Client information will be processed in compliance with applicable data protection laws and used solely for communication, identification, and service delivery purposes.

CloudWind reserves the right to terminate any project if the Client breaches these Terms & Conditions. No refunds will be issued in such cases.

Nothing in these Terms affects your statutory rights as a consumer.

CloudWind operates a strict zero-tolerance policy towards abusive or threatening behaviour towards staff, clients, or third parties—whether in person, online, or via electronic communication.

• Any violation may result in immediate termination of contracts, with outstanding payments due in full.
• Severe cases will be reported to the relevant authorities.
